This website is operated by MARIA By fifty. Throughout the site, the terms “we”, “us” and “our” refer to MARIA by fifty. 
By visiting our site and/ or purchasing something from us, you agree to be bound by the following terms and conditions. These Terms and Conditions apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content. 

Please read these Terms carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. 
Any new features or tools, which are added to, the current store shall also be subject to the Terms of Service. Please read these Terms of Use before using this site. If you do not agree with these Terms of Use, please do not use this site. By using this site, you are agreeing to the Terms of Use incorporated herein. This is true whether or not you are a registered user of this site. We reserve the right to change, modify, add or remove portions of these terms at any time, so please check back periodically for changes. The changes will be effective upon their posting to the MARIA by fifty website. Your continued use of this site after terms are changed (including the Privacy Policy) will constitute your acceptance of such changes.

Our store is hosted by Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
Please note that MARIA by fifty does not guarantee that all products presented on the Website are in stock or are available for purchase. MARIA by fifty reserves its right to stop selling a product. Orders can only be placed by persons that are 18 years or older. 

General

These general terms and conditions of sale apply to all orders placed of the www.mariabyfifty.com, or by email or telephone.

Language 
The language of the Terms and Conditions is English.

Accounts and log in 
When creating an account online, you will be able to choose a password with which you can log in to your account online and view your order history and track your order. If you would like to delete an account you can also contact customercare@mariabyfifty.com and the customer care team will assist you.

Place an Order

By using the Website and/or placing an order on the Website, by telephone, e-mail or by live chat you confirm that you have read the Terms and Conditions and the Privacy Policy and that you accept them. Please make sure that you have read and understood the Terms and Conditions before you place an order. Before you place your order, you will be given the opportunity to review your selections, the information you have provided, the total price of your order and correct any input errors. Please note that products in your shopping bag are not reserved and may be purchased by other customers until you have placed the order at checkout and received the order confirmation email. If prolonged inactivity causes your connection to the Website to fail, your selection of products may be lost. In such case, you will be required to re-enter your selection of products to the shopping bag.

Order Confirmation 
After placing an order, you will receive an order confirmation e-mail with your order number, details of the product you have ordered from us, your payment details and delivery details. Please note that this e-mail is an acknowledgment that we have received your order, this does not mean that your order has been accepted.

Acceptance and shipping confirmation 
All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an email that confirms that the Items have been dispatched (the "Order Shipping Confirmation"). The shipping confirmation is our acceptance of your order. Please note that MARIA by fifty does not guarantee that all products presented on the Website are in stock at the time of your order. If a product is unavailable, we will contact you shortly, by phone or by e-mail. If we already have received payment for such product we will refund you the amount of the purchase.

Price 
The product prices are as displayed on the Website, except in cases of obvious error. The pricing currency is Euro. 
The prices and delivery costs displayed on the Website include Value-Added Tax (VAT). The VAT rate can vary according to the EC intra-community rules in force. All prices are exclusive of shipping rates. Shipping rates are applied per order. The exact shipping rates depend on the country where your order is being delivered to. 
We reserve the right to modify prices on Mariabyfifty.com at any time without notice. Changes will not affect orders in respect of which we have already sent an Order Shipping Confirmation. If you have placed an order and the price has changed before we have accepted your order (by sending you the shipping confirmation), we will notify you by e-mail about the price change and give you the option to place a new order with the new price or cancel the old order. If we are unable to contact you, your order will be canceled. 
The prices and delivery costs displayed on the Website may vary from time to time and MARIA by fifty is not bound by the price until MARIA by fifty has accepted the order by sending the shipping confirmation to you. 
If the correct price of the Items is higher than the price stated on Mariabyfifty.com, we will normally, at our discretion, either contact you for instructions before dispatching the Items, or reject the order and notify you of such rejection.
We are under no obligation to provide the Items to you at the incorrect (lower) price, even after we have sent you an Order Shipping Confirmation if the pricing error is obvious and unmistakable and could have been reasonably been recognized by you as a mispricing.

Payments, security, and transfers of title

Payment
You will pay all charges incurred by users of your credit card, debit card, or other payment method used in connection with a purchase or transaction or other monetary transaction interaction with MARIA by fifty at the prices in effect when such charges are incurred. You will pay any applicable taxes, if any, relating to any such purchases, transactions or other monetary transaction interactions.
Payment can be made by the following payment methods:
— Credit cards and debit cards
Payment can be made by the following credit cards: Visa, Mastercard, and American Express. Payment can also be made by the following debit cards: Visa and Maestro. (Maestro and Visa Electron: please check with your bank to make sure your card is valid for online purchases). The purchases made with Visa and Mastercard are verified by a secure code. Please note that your card is debited with the purchase amount once MARIA by fifty has sent you the order confirmation email. Payment will be debited and cleared from your account upon acceptance of your order by MARIA by fifty. You confirm that the credit/debit card that is being used is yours or that you have been specifically authorized by the owner of the credit/debit card to use it. All credit/debit cardholders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to MARIA by fifty, your order will be canceled. We are not responsible for any charges or penalties which may be imposed by the payment provider as result of a payment being processed in respect of your order.

When selecting the PayPal option, you will be directed to the PayPal site to “Log In” and review the amount shown before clicking “Pay Now”. Once this transaction is complete, you will then return to the Website.

Security
Your payment information is encrypted and will only be transmitted in a protected form over the internet. The payment is processed via the secure payment service of our partner vendors which conforms to required security standards.

Reservation of ownership
Ownership of the Items will only pass to you when we have received full payment of all sums due in respect of the Items. All purchased Items are transported and delivered to you by an independent carrier not affiliated with, or controlled by us. The risk of ownership of Items is transferred to you on delivery.

Shipping and Delivery

All orders are shipped with UPS. Packages are fully insured and traceable and shipped from our warehouse within 1-2 working days.MARIA by fifty offers free shipping on all orders.

Duties

All orders are shipped on a DDU (Delivery Duty Unpaid) basis. Your order may, therefore, be subject to local taxes and import duties, which are levied by your local customs authority or the used shipping carrier. We are unable to calculate the exact amount of duties and taxes your order might incur, as these charges are imposed directly by the destination country and vary between countries. MARIA by fifty does not cover any such taxes, duties or related charges.

Returning an item

You can return Items(s) you bought on Mariabyfifty.com within 15 days of the date of receipt of the Item(s). 
To return an Item you bought, fill out the return slip (on your packing list included in your order). Fill out the style number(s) of the items you wish to return and select a reason for the return.
Send the unwanted Item(s) back to us together with the return slip.
If you no longer have the return slip, please contact Maria by fifty Customer Service at customercare@mariabyfifty.com or by phone. We will issue a return form that you can use to send back the unwanted Item(s).
When you placed your order at mariabyfifty.com you received an email from customercare@mariabyfifty.com with return instructions and a return label. Use this label to return the Item(s). The return label allows you to track and trace your parcel.
Print the return label and attach it to your parcel. Please make sure that it is clearly visible on the parcel and that the address and barcodes are not covered or amended.
Drop your parcel off at the nearest post office. You will have to pay the postage for your return. Please keep the proof of shipment.
If you choose not to use the Maria by fifty return label, the shipping costs to return the Item(s) by ordinary mail or by another appropriate shipping method are at your own charge and risk.
Non-EU countries only: remember to bring your invoice to declare the value of the Item(s) you are returning. Maria by fifty is not responsible for incorrect mailing or excess fees.

Exchanging an Item
To exchange an Item, return the unwanted Item and place a new order on Mariabyfifty.com.
Receiving your refund. 
We will process your return as quickly as possible. After receipt of your returned Item(s), we will refund the purchase price. The time for processing your refund is two (2) weeks (14 calendar days) upon receipt the return item. Your refund will be processed based on how you placed your original order.
Credit card and Paypal: we will credit your account.

Defective products 
If you receive defective products, please notify us immediately. You must always notify MARIA by fifty within a reasonable time after you have detected that the products are defective. If MARIA by fifty consider the products to be defective, MARIA by fifty will make a full refund including shipping costs.

Colors
MARIA by fifty has made every effort to display as accurately as possible the colors of the products that appear on Mariabyfifty.com. As the actual colors you see depend on your computer monitor or mobile device, however, we cannot guarantee and do not warrant that your monitor’s or device’s display of any color will be accurate. 

Written Communications
Applicable laws require that some of the information or communications we send to you should be in writing. When using Mariabyfity.com, you accept that communication with us will be mainly electronic. We will contact you by email or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

All notices given by you to us must be given to customercare@mariabyfifty.com. We may give notice to you at either the email or postal address you provide to us when placing an order, or in any of the ways specified in the above paragraph. Notice will be deemed received and properly served immediately when posted on our website, 24 hours after an email is sent, or three days after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an email, that such email was sent to the specified email address of the addressee.

Resale policy 
You may purchase products on www.mariabyfifty.com for personal use only and not for resale. By placing an order on www.mariabyfifty.com, you certify that you are purchasing products for your own personal use and not for resale and that you accept the Terms and Conditions. We reserve the right to refuse orders for any reason without explanation.

MARIA by fifty responsibility and liability 
MARIA by fifty liabilities to you are limited in each separate case to these Terms and Conditions unless otherwise is stipulated by law. In no case whatsoever will MARIA by fifty assume any liability for indirect damages such as loss of profit or in case of force majeure such as war, civil war, revolution, riot, governmental measures, strike, lockout, blockage, failure of electricity, telephone or internet service, natural disasters or similar events. MARIA by fifty’ liabilities to you will never exceed your total purchase amount for each order. In case of force majeure, MARIA by fifty’ obligations will be suspended. The contract between you and MARIA by fifty can, in such cases, be partially or fully terminated by yourself or by MARIA by fifty.

Other important information
Severability - Each of the sections and paragraphs of these Terms and Conditions operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining sections and paragraphs will remain in full force and effect.
Waiver - If you breach these Terms and Conditions and we take no action, or if we delay in taking action, that does not mean that we have waived our rights and we will still be entitled to use our rights and remedies. If we do waive a breach by you, we will only do so in writing (signed by one of our Directors), and that will not mean that we will automatically waive any later breach by you.
Entire agreement - These Terms and Conditions constitute the entire agreement between you and us and they supersede any and all earlier agreements between you and us.
Events outside of our control - We and the Partners will not be liable or responsible for any failure to perform or delay in performance of, any of our obligations to you if such failure or delay is caused by an event outside of our control.
An event outside of our control means any act or event beyond our or the Partners reasonable control such as act(s) of God, wars, terrorist attacks, embargos, riots, strikes, lock-outs, trade disputes, fires, floods, earthquakes or other natural disasters, break-down, inclement weather, interruption of transport, Government action or failure of public or private telecommunications or transport networks.
If such an event takes place and it affects the performance of our or the Partners’ obligations to you: (i) we will contact you as soon as reasonably possible to notify you; and (ii) our and the Partners’ obligations to you will be suspended for the duration of the event. Where the event affects the delivery of products to you, we will contact you to arrange a new delivery date after the event is over.

Governing Law and Jurisdiction
Anything related to your order, use of the Websites or these Terms and Conditions are governed by Portuguese law. The courts of Portugal shall have the exclusive jurisdiction over any dispute or claim relating to these Terms and Conditions.
